Terms of Use
These Terms of Use ("Terms") govern your use of Frankenstein Audio (the "Service"), operated by GonzyDesigns LLC ("we," "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Frankenstein Audio is a web studio that separates audio recordings you upload into stems, provides tools to arrange and process those stems, and renders audio and video exports. Features vary by plan; paid features are described at the point of purchase.
2. Accounts
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction). You are responsible for your account credentials and for all activity under your account. We may require email verification before enabling certain features.
3. Your content and rights — important
- You retain all rights to audio you upload and to exports you create.
- You grant us a limited license to store and process your uploads solely to operate the Service (separation, analysis, rendering, backups).
- You may only upload audio you have the legal right to use. Processing a recording does not give you rights you do not already have. You are solely responsible for how you use and distribute exports, including obtaining any licenses required for samples, remixes, mashups or public distribution.
- We may suspend or terminate accounts that repeatedly upload infringing material.
4. Copyright complaints (DMCA)
If you believe content stored on the Service infringes your copyright, send a notice identifying the work, the infringing material, your contact information, and a good-faith statement to gonzydesigns@gmail.com. We will remove material and terminate repeat infringers as appropriate.
5. Subscriptions and billing
- Paid plans are billed in advance through Stripe, monthly or yearly, and renew automatically until canceled.
- You can cancel anytime from your Account page; cancellation takes effect at the end of the current billing period, and you keep paid features until then.
- Except where required by law, payments are non-refundable and partial periods are not prorated.
- We may change prices with at least 14 days' notice; changes apply at your next renewal.
- Free-plan limits (library size, export credits, watermarks) are part of the Service and may change.
6. Acceptable use
You agree not to: circumvent plan limits or access controls; resell or provide the Service to third parties as a service; upload malware; use the Service to violate any law or third-party right; or place unreasonable load on the infrastructure (automated scraping, bulk account creation).
7. Our property
The Service — its software, design, models and branding — belongs to GonzyDesigns LLC and its licensors. These Terms grant you a personal, non-exclusive, non-transferable right to use the Service; they do not transfer any ownership.
8. Disclaimers
The Service is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or that separations and exports will meet your expectations. Keep copies of your original files — we are not a backup service.
9. Limitation of liability
To the maximum extent permitted by law, GonzyDesigns LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, data or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose (or $50 if you paid nothing).
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate the Service or your account for breach of these Terms, with notice where practicable. Sections 3, 4 and 7–9 survive termination.
11. Changes and contact
We may update these Terms; material changes will be announced on the site or by email, and continued use after the effective date constitutes acceptance. These Terms are governed by the laws of the United States and the state in which GonzyDesigns LLC is organized. Questions: gonzydesigns@gmail.com.
